I'm not questioning you, I'm telling you what an attorney is going to ask you if you choose to litigate.

The answer is, there is no way you could really know she was doing 50, 45, 35 - you will sit on the stand and look foolish, as they pick you apart....it's not personal, they do it to police officers when they say "it appeared the defendant was speeding". Visual references mean nothing...

Unless the eye-witness has a radar or laser gun on them, and is certified to use it, and had it calibrated the day of your accident, you have nothing.

But hell, it's eating you up, so why not just hire and attorney and ask them what they think.
